1. About Us & Our Affiliation with Fora Travel

Destino Collection is an independent travel advisory operated as a sole proprietorship. We are affiliated with Fora Travel, Inc., a host travel agency, and arrange travel under Fora's agency accreditation and Seller of Travel registrations.

Fora Travel, Inc. is a registered Seller of Travel in California, Florida, and Washington, and travel we arrange is booked under Fora's Seller of Travel registrations. Registration as a Seller of Travel does not constitute approval or endorsement by any state. Current registration details are available from Fora Travel upon request.

2. Our Role as a Travel Advisor

We act solely as an intermediary and independent travel advisor between you and third-party travel suppliers, including but not limited to hotels, resorts, airlines, cruise lines, tour operators, transportation providers, ground handlers, and destination management companies (collectively, "Suppliers").

We do not own, manage, control, or operate any Supplier or the travel services they provide. All bookings are subject to the individual terms, conditions, and policies of the applicable Supplier, which form a direct contract between you and that Supplier. You are responsible for reviewing and complying with all Supplier terms before booking.

3. Planning Fees & Service Charges

We may charge professional planning fees, service fees, or consultation fees for our time and expertise. Any such fees will be disclosed to you in advance and are separate from the cost of your travel arrangements.

Unless expressly stated otherwise in writing, all planning and service fees are non-refundable once work has commenced, as they compensate us for professional services rendered regardless of whether you ultimately book or travel.

4. Pricing, Deposits & Payment

• All pricing is quoted in U.S. dollars unless otherwise stated and is not guaranteed until fully paid and confirmed by the Supplier.
• Prices, availability, and promotions are set by Suppliers and may change without notice until booking is confirmed.
• Deposits and final payments are made according to each Supplier's schedule. Failure to pay on time may result in cancellation and loss of deposits.
• Payments for travel arrangements are typically made directly to the Supplier or through Fora's booking systems. You are responsible for any currency conversion fees, foreign transaction fees, or bank charges.

5. Cancellations, Changes & Refunds

Cancellations, date changes, modifications, and refunds are governed exclusively by the terms of the applicable Supplier. Many bookings are non-refundable or carry cancellation penalties that can equal the full cost of the trip.

We will assist you in communicating cancellation or change requests to Suppliers, but we cannot guarantee any refund, credit, or waiver. Any refunds issued by a Supplier are subject to that Supplier's processing timelines. Our planning and service fees remain non-refundable.

6. Travel Insurance

We strongly recommend that you purchase comprehensive travel insurance to protect against unforeseen events, including trip cancellation, interruption, delay, medical emergencies, evacuation, and lost or damaged baggage. If you decline travel insurance, you assume full financial responsibility for any losses that insurance might otherwise have covered.

7. Travel Documents, Passports & Visas

You are solely responsible for ensuring that you hold valid travel documents, including a passport (typically valid for at least six months beyond your return date), any required visas, transit permits, and other entry documentation for every destination and connection on your itinerary.

We can provide general guidance, but we are not responsible for denied boarding, denied entry, or any losses arising from inadequate or invalid documentation.

8. Health & Entry Requirements

You are responsible for understanding and complying with all health, vaccination, and entry requirements for your destinations. We recommend consulting official government sources and a medical professional regarding any health precautions. We are not liable for any consequences arising from your failure to meet these requirements.

9. Travel Advisories & Assumption of Risk

Travel may involve inherent risks. You are responsible for reviewing current travel advisories, including those issued by the U.S. Department of State and the Centers for Disease Control and Prevention. By booking travel, you acknowledge and voluntarily assume all risks associated with your travel arrangements.

10. Limitation of Liability & Disclaimer of Warranties

To the fullest extent permitted by law, Destino Collection shall not be liable for any loss, injury, damage, delay, or expense arising from the acts, errors, omissions, defaults, or negligence of any Supplier or third party, or from events beyond our reasonable control.

Our services are provided on an "as is" basis without warranties of any kind, express or implied. In no event shall our total liability to you exceed the total amount of planning or service fees you paid directly to Destino Collection for the arrangements giving rise to the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless Destino Collection and its owner from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your travel, your breach of these Terms, or your violation of any Supplier terms or applicable law.

12. Force Majeure

We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to natural disasters, severe weather, pandemics or epidemics, acts of government, war, terrorism, civil unrest, strikes, or Supplier insolvency.

13. Privacy

We collect and use your personal information solely to arrange and service your travel. Information may be shared with Suppliers, Fora Travel, and related service providers as necessary to fulfill your bookings. We do not sell your personal information. By engaging our services, you consent to this use of your information.

14. Intellectual Property

All content on this website, including text, imagery, design, and the Destino Collection name and marks, is owned by or licensed to Destino Collection and may not be reproduced or used without prior written permission.

15. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Texas, without regard to its conflict of laws principles. Any dispute arising from these Terms or our services shall be resolved in the state or federal courts located in Texas, and you consent to their jurisdiction.

16. Changes to These Terms

We may update these Terms from time to time. The most current version will always be posted on this page with the "Last updated" date. Your continued use of our services after any changes constitutes acceptance of the revised Terms.
